We are committed to protecting your personal data in compliance with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and all other applicable privacy laws. 1. Information We Collect

Information you provide directly: When you register, upload images, submit edit instructions, or contact support, we collect your username, email address, payment information (processed via encrypted payment gateways; we do not store full card numbers), and the images you upload (solely to fulfill your editing requests).

Information collected automatically: IP address, browser type, device identifiers, timestamps, and interaction data collected via cookies and similar technologies (e.g., features used, number of edits).

2. Legal Basis for Processing (GDPR)

We process your personal data based on the following legal grounds:

Performance of a contract: To provide our image editing services.
Legitimate interests: To improve our product, prevent fraud, and analyze website performance.
Consent: When you accept cookies or subscribe to marketing communications.
Legal obligation: To comply with tax or regulatory requirements.

4. Data Storage and Transfers

Your images and personal data are stored on servers located in Frankfurt, Germany (EU) and Virginia, USA (in compliance with Standard Contractual Clauses). We use AES-256 encryption for data in transit (TLS 1.3) and at rest. Uploaded images are retained for 30 days after processing, unless you explicitly request deletion or close your account.

            
            International Data Transfers: When we transfer data outside the European Economic Area (e.g., to the US), we ensure appropriate safeguards are in place, such as EU Standard Contractual Clauses (SCCs) or adequacy decisions (e.g., Data Privacy Framework).
        

5. Cookies and Tracking Technologies

PhotoEd is not intended for children under the age of 16. We do not knowingly collect personal data from children. If you believe we have inadvertently collected such information, please contact us immediately so we can delete it.

Terms of Service

Welcome to PhotoEd. By accessing or using our website and services, you agree to be bound by these Terms ("Terms"). If you are entering into this agreement on behalf of a legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you may not use the Service.

1. Service Description

PhotoEd provides AI-powered image editing tools (the "Service"). You upload images and provide prompts, and we use artificial intelligence to generate modified versions. We reserve the right to modify or discontinue the Service at any time, but we will provide advance notice where reasonably possible (except in cases of urgent technical issues).

2. Accounts and Registration

You must provide accurate and complete information when creating an account. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use. We reserve the right to refuse registration or terminate an account, particularly if you violate these Terms.

3. Payments, Renewals, and Refunds (EU Consumer Rights)

Fees: Fees for VIP services are clearly displayed at checkout and include VAT where applicable. Prices are subject to change, but changes will not affect existing subscriptions.
Auto-Renewal: Unless you cancel, VIP subscriptions will automatically renew. We will send a reminder email before renewal. You can disable auto-renewal in your account settings.
Right of Withdrawal (Refunds): In accordance with the EU Consumer Rights Directive, you have the right to withdraw from your purchase within 14 days without giving any reason. If you have not used any paid editing credits (or downloaded any AI results) within those 14 days, contact us for a full refund. If the Service has been partially consumed, we will provide a pro-rata refund. Your right of withdrawal may be limited for digital services that have been fully performed, as permitted by local law.

4. User Content and Intellectual Property

Your Ownership: You retain all ownership rights to the images you upload. By uploading, you grant us a worldwide, limited license to host, process, and provide the Service (e.g., storage, analysis, generating results). This license terminates when you delete your account, subject to reasonable technical caching.

AI-Generated Results: You have full commercial rights to the edited images generated by our AI, provided they are not used for illegal, infringing, or hateful purposes. We are not liable for the final legality of the generated content.

Feedback: Any suggestions or feedback you provide may be used to improve our services without compensation to you.

             Prohibited Content: You agree not to upload or generate any content that infringes on privacy, copyright, trademark, or that is obscene, violent, discriminatory, or violates applicable law (including the EU Digital Services Act). We reserve the right to review and refuse to process content that violates this policy.
        

5. Copyright Infringement (DMCA / EUCD)

If you believe that your copyrighted work has been uploaded without authorization, please provide our designated agent with the following information: (a) a physical or electronic signature of the copyright owner; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement of good faith belief that the use is not authorized. We will promptly investigate and respond to valid complaints under the Digital Millennium Copyright Act (DMCA) and the EU Copyright Directive.

6. Disclaimers and Limitation of Liability

Service "AS IS": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-generated results may contain errors or inaccuracies; you use them at your own risk.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PhotoEd SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE. IN ANY EVENT, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

7. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service for violations of these Terms or prolonged inactivity. We will notify you of such action unless prohibited by law. Upon termination, you remain responsible for any fees incurred.

8. Governing Law and Dispute Resolution

For EU Residents: These Terms are governed by the laws of the country of your residence, without prejudice to mandatory consumer protection laws. Disputes should first be attempted to be resolved through the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

For US Residents: Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless the claim is within the jurisdiction of a small claims court. You agree to waive the right to participate in a class action lawsuit or class-wide arbitration.

9. Changes to Terms

We may modify these Terms from time to time. We will provide at least 30 days' notice of material changes by posting a notice on our website or sending an email. Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.
